Skype coming to BlackBerry 10 devices

These days, an OS is only as good as its ecosystem, and it's one of the biggest question marks circling around the brand new BlackBerry 10. Without a solid selection of apps and entertainment options, RIM BlackBerry will have a difficult time persuading Android and iOS users to give the smartphone platform another chance. The company is currently in the middle of announcing a load of app and media partnerships for the nascent OS, and fortunately Skype is showing up on the grid of icons at the keynote.

Arsonist gets death sentence for heart attacks

SAN BERNARDINO, Calif. (AP) ? A decade after a raging fire swept through Southern California's San Bernardino foothills, an arsonist was sentenced to death for causing the deaths of five men who died of heart attacks.

It was an unusual legal interpretation of murder likely to be debated in appellate courts.

A lawyer for Rickie Lee Fowler, 31, suggested in arguments Monday that he could not have foreseen that anyone would die and said there was lingering doubt about whether he threw a road flare that was believed to have started the blaze. A second man was seen with him that night.

Superior Court Judge Michael Smith imposed the punishment recommended by a jury in spite of the fact that the victims did not die by Fowler's hand. They died of heart attacks allegedly brought on by the stress of evacuating their homes as flames raged.

Smith had the option of reducing Fowler's sentence to life in prison without the possibility of parole. He declined.

"Today, after nearly ten years, justice has now been secured for the victims and their families, and those whose lives were affected by the actions of Rickie Lee Fowler," said District Attorney Michael Ramos.

Fowler was convicted in August of five counts of first-degree murder and two counts of arson.

Prosecutors said Fowler lit the fire in 2003 out of rage after he was thrown out of a house where his family was staying.

The blaze scorched more than 142 square miles in October 2003 and destroyed 1,000 buildings as it burned for nine days in the foothills above San Bernardino. The men died after their homes burned or as they tried to evacuate.

Fowler became a suspect after witnesses reported seeing a passenger in a white van tossing burning objects into dry brush. Investigators interviewed Fowler several months after the fire but didn't have enough evidence to file charges until six years later.

Some legal experts previously said the jury's death recommendation for a crime tangential to the arson appeared to be unprecedented. Loyola Law School professor Stan Goldman said a key consideration was whether it was foreseeable to Fowler that five men would die of heart attacks when he set the fire.

He cited a 1982 U.S. Supreme Court decision reversing the death sentence of a man charged with aiding and abetting a murder. The court held that the sentence should not apply to someone who didn't kill, attempt or intend to kill the victim.

Smith said the evidence shows Fowler personally and intentionally started the blaze.

Fowler, who had a long criminal record, was back in prison for burglary by the time authorities charged him with setting the blaze, one of many fires that raged simultaneously throughout Southern California in 2003.

He also was convicted of serial sodomy of an inmate and sentenced to three terms of 25 years to life while in prison awaiting trial.

Prosecutors at the arson trial portrayed Fowler as a sadistic felon who raped, robbed and tortured people throughout his life.

Defense attorneys said Fowler never acknowledged starting the fire and suffered a horrific childhood with methamphetamine-addicted parents and a neighbor who molested him.

Prosecutors said Fowler gave authorities a note in 2008 acknowledging he was there when the fire began. The following year, he told reporters he had been badgered into making a confession.

Defense attorney Don Jordan said before sentencing that there was doubt about whether Fowler was responsible for the blaze, and his client didn't know where or when it started.

"For all these reasons, please don't impose the death penalty on this poor creature before you," Jordan told the judge.

Randy Couture will coach on Bellator reality series

Randy Couture is a member of the UFC Hall of Fame. He fought in the Octagon 23 times, and held the heavyweight and light heavyweight UFC belts. But according to a report from Sports Illustrated, his next move will be with Bellator.

Couture has reportedly signed on to do multiple projects with Viacom, the media conglomerate that has a major stake in Bellator and owns Spike TV, Bellator's TV partner. Couture's first project will be to coach on an upcoming MMA reality TV series.

This won't be Couture's first time in that role. Along with Chuck Liddell, Couture was a coach on the first season of "The Ultimate Fighter." That show helped catapult the UFC to the level it is on today.

Bellator is smartly banking on Couture's popularity as a fighter and an actor to help grow their promotion.

Unusual Weather Hits Most of Country

A fluctuation in the jet stream unusual for mid-winter has created a wild range of weather.

Tornado watches have been issued for parts of Oklahoma, Texas, Kansas, Missouri and Arkansas, and April-like thunderstorms are expected in Chicago.

Other states from Texas to Florida, Kansas and parts of the Midwest and Northeast are experiencing record heat. Record warmth is expected today ahead of the storms, with record highs possible in Chicago, St. Louis and Tampa that could reach 60 degrees or more, 73 degrees and 83 degrees, respectively.

Additionally, a powerful cold front will slam into the mid-Mississippi Valley today, producing tornadoes and gusty winds near 80 mph. The biggest chance for tornadoes is from Little Rock, Ark., to Memphis, Tenn., but the entire area from Dallas to Houston, New Orleans, Chicago, Indianapolis and St. Louis could see tornadoes and damaging winds.

The storms will also create flooding from the Midwest to the Northeast, with some areas getting as much as three inches of rain.

The unusual weather will linger through this evening. Areas most at risk for tornadoes include southern Illinois, southwest Indiana, western Kentucky, northern Louisiana, Mississippi, southeast Oklahoma, western Tennessee and northeast Texas, according to NOAA's Storm Prediction Center.

Behind the flooding rain and record warmth, cold air is expected to move in this week.

Already in the West, 18 states from Michigan to New Mexico and up to Washington have winter weather warnings and advisories. Blizzard-like conditions might develop on Thursday for places including Des Moines, Iowa; Rochester, Minn.; Eau Clair, Wis., and Green Bay, Wis. These areas will see as much as eight inches of snow, with gusty winds near 35 to 45 mph. The combination could create white-out conditions.

The weather will shift dramatically in Chicago by Thursday, dropping from the record high of more than 60 degrees today to 17. Sub-zero wind chill temperatures are likely for most of the Midwest.

Along the East Coast, warm air is moving in. Highs will approach 50 degrees today in New York City, with a high of 60 possible Wednesday. Washington, D.C., will approach the mid- to upper-60s Wednesday.

The cold air will finally arrive in the Northeast and the East Coast by Friday, blasting the areas with frigid temperatures for the weekend, sweeping in from D.C. to Boston.

(AP) ? Heat rising up from cities such as New York, Paris and Tokyo might be remotely warming up winters far away in some rural parts of Alaska, Canada, and Siberia, a surprising study theorizes.

In an unusual twist, that same urban heat from buildings and cars may be slightly cooling the autumns in much of the Western United States, Eastern Europe and the Mediterranean, according to the study published Sunday in the scientific journal Nature Climate Change.

Meteorologists long have known that cities are warmer than rural areas, with the heat of buildings and cars, along with asphalt and roofs that absorb heat. That's called the urban heat island effect and it's long been thought that the heat stayed close to the cities.

But the study, based on a computer model and the Northern Hemisphere, now suggests the heat does something else, albeit indirectly. It travels about half a mile up into the air and then its energy changes the high-altitude currents in the atmosphere that dictate prevailing weather.

"Basically, it changes the flow." said Guang Zhang of the Scripps Institution of Oceanography in La Jolla, Calif. He wrote the paper with Aixue Hu at the National Center for Atmospheric Research in Boulder, Colo.

This doesn't change overall global temperature averages significantly, unlike man-made greenhouse gases that cause global warming. Instead it redistributes some of the heat, the scientists said.

The changes seem to vary with the seasons and by region because of the way air currents flow at different times of the year. During the winter, the jet stream is altered and weakened, keeping cold air closer to the Arctic Circle and from dipping down as sharply, Hu explained.

The computer model showed that parts of Siberia and northwestern Canada may get, on average, an extra 1.4 degrees to 1.8 degrees Fahrenheit (0.8 to 1 degree Celsius) during the winter, which "may not be a bad thing," Zhang said. The effect isn't quite as much in northern North Dakota and Minnesota, where temperatures might be about half a degree warmer (0.3 degrees Celsius), and even less along the East Coast.

In contrast, Europe and the Pacific Northwest are cooled slightly in the winter from this effect. The jet stream changes prevent weather systems from bringing warmer air from the Atlantic to Europe and from the Pacific to the U.S. Northwest, thus cooling those areas a bit, he said.

The biggest cooling occurs in the fall, but Hu said he's not quite sure why that happens.

Several outside scientists said they were surprised by the study results, calling the work "intriguing" and "clever." But they said it would have to be shown in more than one computer model and in repeated experiments before they could accept this theory.

"It's an interesting and rationally carried out study," said David Parker, climate monitoring chief of the United Kingdom meteorology office. "We must be cautious until other models are used to test their hypothesis."

California still hasn't bought land for bullet train route

Construction of California's high-speed rail network is supposed to start in just six months, but the state hasn't acquired a single acre along the route and faces what officials are calling a challenging schedule to assemble hundreds of parcels needed in the Central Valley.

The complexity of getting federal, state and local regulatory approvals for the massive $68-billion project has already pushed back the start of construction to July from late last year. Even with that additional time, however, the state is facing a risk of not having the property to start major construction work near Fresno as now planned.

It hopes to begin making purchase offers for land in the next several weeks. But that's only the first step in a convoluted legal process that will give farmers, businesses and homeowners leverage to delay the project by weeks, if not months, and drive up sales prices, legal experts say.

One major stumbling block could be valuing agricultural land in a region where prices have been soaring, raising property owners' expectations far above what the state expects to pay.

"The reality is that they are not going to start in July," said Anthony Leones, a Bay Area attorney who has represented government agencies as well as property owners in eminent domain cases.

State high-speed rail officials say it won't be easy, but they can acquire needed property and begin the project on time.

"It is a challenge," said Jeff Morales, the rail agency's chief executive. "It is not unlike virtually any project. The difference is the scale of it."

Quickly acquiring a new rail corridor is crucial to the project, which Gov. Jerry Brown touted last week as the latest symbol of California's tradition of dreaming big and making major investments in its future.

Delays in starting construction could set in motion a chain reaction of problems that would jeopardize the politically and financially sensitive timetable for building the $6-billion first leg of the system. Under its deal with the Obama administration, which is pushing the project as an integral part of its economic and transportation agenda, the state must complete the first 130 miles of rail in the Central Valley by 2018, an aggressive schedule that would require spending about $3.6 million every day.

California voters in 2008 approved plans for a 220-mph bullet train system that would initially link the Bay Area and Southern California at a cost of $32 billion, less than half the estimated cost of the project.

If the construction schedule slips, costs could grow and leave the state without enough money to complete the entire first segment. Rail agency documents acknowledge initial construction may not get as close to Bakersfield in the southern Central Valley as planned.

In addition to property, the rail authority still needs permits from the Army Corps of Engineers and approval by the San Joaquin Valley Air Pollution Control District, two more potential choke points that Morales says can be navigated.

The land purchases are waiting on the hiring of a team of specialized contractors, but they cannot start their work until the rail agency gets approval from another branch of the state bureaucracy. About 400 parcels are needed for the first construction segment, a 29-mile stretch from Madera to Fresno.

The formal offers will start an eminent domain action, the legal process for seizing land from private owners. The owners have 30 days to consider the offer, and then the state must go through a series of steps that can add 100 more days of appeals and hearings, assuming the state can get on the court calendar, according to Robert Wilkinson, an eminent domain litigator in Fresno. If the state fails to convince a judge that a quick takeover of property is justified, formal trials could stretch on for 18 months, he added.

"I would think a lot of these are going to end up in litigation," he said. "It is a tight schedule, no question about it."

Indeed, the rail authority's formal right-of-way plan indicates it does not expect to acquire the first properties until Sept. 15, despite other documents that indicate construction would start in July. Rail officials said they padded the schedule to avoid claims for additional payments by construction contractors should land not be available by July.

Last month, the federal Government Accountability Office reported that about 100 parcels were at risk of not being available in time for construction.

That assessment was based on information the office collected last August. Susan Fleming, a GAO investigator, testified at a House hearing last month: "Not having the needed right of way could cause delays as well as add to project costs."

Morales said in a recent interview that he would not argue with the warning in the GAO report but still sees nothing that would delay the start of construction. Technically, the rail authority could meet the July target date by beginning demolition or other construction on a single piece of property, he said.

Anja Raudabaugh, executive director of the Madera County Farm Bureau, which is suing to halt the project under the California Environmental Quality Act, said the rail authority will face strong opposition to condemnation proceedings in the Central Valley. The bureau has hired a condemnation expert to help battle the land seizures.

"It is a harried mess," she said.

She noted that agricultural land prices rose rapidly last year across the nation. In the Central Valley, the average price of farmland is $28,000 per acre, while the rail authority's budget anticipates an average price of $8,000 per acre, she said.

Kole Upton, an almond farmer who leads the rail watchdog group Preserve Our Heritage, questioned the rail agency's expertise in conducting complex appraisals of agricultural land that has orchards, irrigation systems and processing facilities.

"I am not sure this thing has been well thought out by people who have a deep understanding of agriculture," Upton said. "I live on my farm, and my son lives on my farm. My dad started it after World War II. This is our heritage and our future."

Morales said he believes the agency's budget for property acquisitions is adequate and he did not want to negotiate prices publicly.

"We don't think we are wildly off," he said.

Honolulu funnyman James Mane is venturing into philanthropy with his upcoming showcase, starring nationally recognized standup comedian Graham Elwood; the show will benefit the Wounded Warrior Project, which aids military vets injured in the course of duty.

Inspired to put on a show that would contribute to the greater good, Mane assembled a show that follows through on its theme: Elwood is a comedian familiar to the troops, who?s done seven USO tours in Afghanistan, Kuwait and Iraq.

Elwood also put together a documentary, ?Laffghanistan: Comedy Down Range,? about his experience in Afghanistan. ?You can see the emotion. He?s experienced a little of what our heroes go through,? Mane said.

?That?s when it hits you. ? You can see it in his eyes. It?s almost like he?s a kid lost in a store, and everyone in that store wants to hit you.?

The film is available for viewing online for a donation.

Mane hosted for Elwood when the comedian performed at Pipeline last year: ?Really nice guy,? Mane said. ?He?s probably more famous for his podcasts ? they get 15 thousand to 20 thousand downloads per week.?

Local comedian Patrick Tyrell, also on the bill, is one of the good guys too; in his other life, he provides service to Marines who?ve suffered injuries and lost limbs, working to provide them with training and equipment that will allow them to enjoy the athletic pursuits they choose.

Similarly, the Wounded Warrior Project helps injured military to regain fullness of life; it?s well worth supporting. Wounded Warriors wristbands will be given out at the event.

Mane, a bus driver in his other life, said he was simply inspired to support the organization one day when he saw a sign for Wounded Warriors on his bus. ?I thought it would be nice to support charity,? he said. ?I might not be the nicest person or the best, but I want to support the community.? And then he can?t resist joking about it a little bit: ?For all the bad that we?ve done in our lives.?

People who pay into Social Security and Medicare their whole working lives are often told by politicians that they've 'earned' these retirement benefits. Here's why that's not necessarily so.

The question arises because earlier this week House Budget Committee Chairman Paul Ryan (R) of Wisconsin said they are. Appearing on Laura Ingraham?s radio show on Jan. 22, Representative Ryan said President Obama had mischaracterized the GOP?s attitude toward the nation?s big social insurance programs.

?No one is suggesting that what we call our earned entitlements ? entitlements you pay for, like payroll taxes for Medicare and Social Security ? are putting you in a ?taker? category,? said Ryan. ?No one would suggest that whatsoever.?

Of course, Ryan is far from the only politician to describe Social Security and Medicare in this manner. The wording may be more common among Democrats, who often imply that these programs are simply keeping folks? tax cash warm until they need it ? so hands off!

Let?s quote Mr. Obama himself from an appearance last September before an American Association of Retired Persons audience: ?I want to emphasize, Medicare and Social Security are not handouts. You?ve paid into these programs your whole lives. You?ve earned them.?

To this we say, weelllll, not really. The situation is more complicated than that.

It?s true that workers fork over Social Security and Medicare taxes every payday. But under current law, over their lifetimes most Americans will get back substantially more from these programs then they?ve paid in, even after accounting for inflation and adjusting for interest you might have earned if you?d kept the money.

That?s primarily due to the rising value of projected Medicare health benefits. Social Security is a different story. In recent years the raising of the Social Security retirement age, plus other tweaks, have made the big retirement income entitlement less generous. New retirees won?t get back quite as much income support as they?ve contributed in Social Security taxes.

However, individual tax/benefit ratios for both programs are highly variable, depending on lifetime earnings, longevity, marital status, and health conditions.

Got all that? We weren?t kidding when we said it was ?complicated.?

UK urges Britons to leave Libya's Benghazi over threat

TRIPOLI/LONDON (Reuters) - Britain urged its nationals to leave the eastern Libyan city of Benghazi on Thursday, citing a "specific and imminent" threat to Westerners days after a deadly attack by Islamist militants in neighboring Algeria.

Britain's Foreign Office declined to give details of the nature of the threat, but has warned in the past of the long reach of al Qaeda in the Islamic Maghreb, the North African wing of al Qaeda.

At least 38 hostages were killed in an attack on the remote In Amenas gas complex in Algeria, about 100 kms (60 miles) from the Libyan border. French forces are also fighting Islamist rebels in Mali.

"We are now aware of a specific and imminent threat to Westerners in Benghazi, and urge any British nationals who remain there against our advice to leave immediately," the Foreign Office said in a statement.

Few Westerners are believed to be in Benghazi, which has experienced a wave of violence targeting foreign diplomats, military and police officers, including an attack in September that killed the U.S. ambassador and three other Americans.

A spokeswoman for the British embassy in Tripoli said the number of British nationals in Benghazi was small, but could not comment on specific numbers.

Last week Italy suspended activity at its Benghazi consulate and withdrew staff after a gun attack on its consul.

Coupled with the Algeria hostage crisis - a plan believed to have been conceived in Mali - Western governments are now on high alert.

"The situation in Cyrenaica (eastern Libya) is not just worrying, it is incredibly worrying. Everybody is on alert," a Western diplomat said. "But in light of the events recently (in Algeria and Mali), this could be a precautionary measure."

Saad al-Saitim, deputy head of the Benghazi Local Council, said the warning was a setback, inciting "more fear at a time when people need to stand with us".

"Following the Mali events, foreigners are worried and are taking precautionary steps. Benghazi hardly has any foreigners at the moment and few foreign consulates," he said.

British Airways said it would continue operating flights to the Libyan capital Tripoli. The airline operates three flights a week between London's Heathrow airport and Tripoli. Its next flight to Libya is scheduled for Sunday.

The eastern city of Benghazi was the cradle of the 2011 revolution that toppled former dictator Muammar Gaddafi, and Libya has been awash with weapons since then, its shaky nascent institutions struggling to rein in armed groups.

Benghazi in particular has been the scene of power struggles between various armed Islamist factions. U.S. intelligence officials say Islamist militants with ties to al Qaeda affiliates were most likely involved in the deadly September 11 assault on the U.S. mission in the city, Libya's second biggest.

While Britain's move may be only precautionary, it is unlikely to inspire confidence in a country keen to attract foreign cash and developers for its oil fields and other sectors after years of chronic under-investment and war.

The bulk of Libya's oil wealth, around 80 percent, is located in the east of the country but the oil installations are far from Benghazi and oil is not piped through there.

Giuma Attaigha, deputy leader of the ruling general national congress, told Reuters Libya must make foreigners feel safe.

"This statement is a cause of concern and we hope it is just precautionary because it is the right of any country to take care of its people when it feels that they are in danger," he said.

"This forces all of us, starting with the security forces in the interior ministry, to take all necessary steps and quickly to make the foreigners feel safe and to protect citizens in Benghazi against terrorism."

AIG counsel told board Greenberg lawsuit has low chance of success

(Reuters) - AIG Inc's counsel informed its board that a bailout lawsuit filed by former chief executive Hank Greenberg against the U.S. government has a low likelihood of success, as the insurer weighed whether to join the suit, according to a court filing.

Greenberg's case, brought on behalf of his company Starr International Co, accused the U.S. government and the New York Federal Reserve of wasting more than $60 billion of AIG and taxpayer funds in a "backdoor bailout" that let "favored" trading partners, such as Goldman Sachs Group Inc , be repaid in full and freed from legal liability.

Insurer AIG weighed whether to join the lawsuit filed by Greenberg and his company, which owned 12 percent of AIG before its $182 billion rescue that started in 2008.

However, facing anger from Congress and the American people, AIG said earlier this month that it would not sue the U.S. government over the terms of the bailout.

In a letter filed with a New York court on Wednesday, AIG lawyer Paul Curnin said he put Starr's likelihood of success "at no more than 20 percent."

Curnin said the available evidence, including more than 3000 pages of exhibits, did not support Starr's assertion that the U.S. government or the New York Fed coerced AIG's board into accepting the bailout loans in September 2008.

The court filing showed that before deciding not to join Greenberg's lawsuit the AIG board discussed issues such as potential damage to the company's brand and image.

The Treasury sold the last of AIG's stake in mid-December 2012. The government has said it earned a return of $22.7 billion on the rescue.

The cases are Starr International Co v. Federal Reserve Bank of New York, U.S. District Court, Southern District of New York, No. 11-08422; and Starr International Co v. U.S., U.S. Court of Federal Claims, No. 11-00779.

(AP) ? Within hours of Shakira's baby boy being born, people are already asking about his future career.

Will Milan Pique Mebarak be a famous pop singer liker his Colombian mother, or an international soccer star like his Spanish father, Barcelona defender Gerard Pique?

"Welcome Milan Piqu? Mebarak and congratulations to Shakira and Gerard Pique. What would you prefer as a present for the baby, a microphone or some (soccer) boots?" Manchester City striker Sergio "Kun" Aguero wrote Wednesday on Twitter.

Shakira, 35, gave birth to her first child Tuesday in Barcelona in northeastern Spain. Both the boy and mother were said to be in fine health.

Pique's grandfather, Amador Bernabeu, said the couple was delighted.

"I still haven't seen him (Milan) in person but I know he is dark-haired and weighs 2.9 kilograms (6 lbs)," Bernabeu told RAC-1 radio.

Congratulatory messages rained down on the couple from both sides of the Atlantic.

Colombian President Juan Manuel Santos was among the first to wish them the best, while the Pies Descalzos (Shoeless) Foundation for poor children set up by Shakira in 1997 sent a Twitter message saying, "The children and Pies Descalzos team are happy for Milan's birth. We love you Shakira!"

Barcelona midfielder Cesc Fabregas tweeted a welcome to the baby, saying he "can't wait to meet you."

Antonella Roccuzzo, the girlfriend of Argentine soccer ace Lionel Messi, tweeted "Welcome to the world Milan Pique Mebarak. Now Thiaguin will have a great friend," in reference to her recently-born son.

One of the big surprises was child's first name. In a statement, Shakira said Milan was of central European origin and meant "loved, full of grace, loving," in Slavic and "unification" in Sanksrit.

Milan, coincidentally, is also the name of the famous soccer team from that Italian city and Barcelona's next rival in the European Champions League.

Bernabeu admitted the family was surprised by the choice and confessed he had never heard of the name. "I think Milan will become fashionable," he told the radio.

The grandfather, a former director of the Barcelona club, made sure Milan was registered as a club member as soon as he was born.

Shakira and the 25-year-old Pique have been a couple for the past two years and are regularly featured in gossip magazines and TV programs in both Europe and Latin America.

This year?s Short Film program is comprised of 65 short films selected from a record 8,102 submissions. The Short Film jurors are: Mike Farah, President of Production for Funny or Die; Don Hertzfeldt, Academy Award? nominated American independent filmmaker; and Magali Simard, short film programmer for the Toronto International Film Festival.
The Short Film program at the 2013 Sundance Film Festival is presented by YouTube.
